This AIStor Free Agreement is entered into and effective as of the earlier of the date (i) the date the entity (hereinafter “Customer”) download, accesses or uses the Products; or (ii) the date Customer clicks a box indicating acceptance of this Agreement (the “Effective Date”) and MinIO, Inc., a Delaware corporation with its principal place of business at 275 Shoreline Drive, Suite 100, Redwood Shores, CA 94065 (“MinIO”) and governs Customer’s use of the Products as defined herein. Each of MinIO and Customer are referred to herein individually as a “Party” and collectively as the “Parties.”
AIStor Free (“Products”) is intended to allow customers to deploy and use MinIO AIStor at no cost in a Standalone Configuration for production, development, testing, and evaluation purposes. Distributed, clustered, or multi-node deployments require a paid AIStor subscription and are not permitted under this Agreement. A “Standalone Configuration” means a single, non-distributed instance of the Product that does not participate in any cluster, federation, or multi-node deployment, regardless of the underlying infrastructure or execution environment.
BY DOWNLOADING, USING, AND/OR LICENSING SUCH PRODUCTS EITHER (I) BY CLICKING A BOX INDICATING ACCEPTANCE, OR (II) ACCEPTING DELIVERY AND USING PRODUCTS, CUSTOMER AGREES TO BE BOUND BY THESE AGREEMENT. THIS AGREEMENT APPLIES TO ALL CURRENT AND FUTURE USE AND ACCESS OF MINIO PRODUCTS BY CUSTOMER UNLESS EXPRESSLY AGREED OTHERWISE BY CUSTOMER AND MINIO IN WRITING.
This Agreement may be periodically updated from time to time, and the current version will be posted at https://min.io/legal. Customer’s continued use of the Products after a revised Agreement has been posted constitutes Customer’s acceptance of its terms.
AIStor Free is provided as a free subscription and is subject to the Customer License and Subscription Agreement available at https://www.min.io/legal/customer-license-and-subscription-agreement (“CLSA”). The CLSA and this AIStor Free Agreement are collectively, the “Agreement”. Capitalized terms not defined herein shall have the same meaning as in the CLSA.
1. License Grant. Subject to the terms and conditions of this Agreement, MinIO grants Customer a limited, worldwide, non-exclusive, non-transferable, non-assignable, non-sublicensable, revocable license to download, install, and use the Products solely in a Standalone Configuration for Customer’s internal business purposes, including production use, development, testing, and evaluation.

3. No Support Services. The Product is provided without support, maintenance, SLAs, or access to MinIO’s subscription network (SUBNET). In the event Customer would like support services or access to all features and functions, Customer acknowledges that it must upgrade to AIStor Enterprise Lite or AIStor Enterprise.
4. Term. This Agreement begins on the Effective Date and continues until terminated (“Term”). MinIO may terminate for Customer’s material breach.
5. Government Use. AIStor Free does not include the compliance certifications, statutory warranties, or security commitments typically required for Government Entities or highly regulated production environments. Any additional rights or changes to this Agreement is subject to written approval by MinIO. For purposes of this Agreement, “Government Entity” means any government (whether federal, state, provincial, territorial, local, municipal, foreign, international, supranational, or otherwise), government agency, government department, government authority, government contractor, government subcontractor, quasi-governmental entity, public authority, or any entity that is owned, controlled, sponsored, commanded, influenced, or supervised by any government or any subdivision, agency, or instrumentality thereof.
6. CLSA Applicability. The following sections of the CLSA do not apply Section 2 (Orders and Payment), Section 3.3 (Customer Account), Section 4.6 (Support Services), Section 7 (Data Protection, Privacy and Security), Section 9.2 (MinIO Warranties), 9.3 (Warranty Remedies), Section 10 (Indemnity), and Section 14.11 (Modifications, Variations, and Updates).
If there is a conflict or inconsistency between this AIStor Free Agreement and the other portions of the CLSA, this AIStor Free Agreement will prevail for those matters contained herein. No modification, amendment, or waiver of any provision of this Agreement shall be effective unless in writing and signed by MinIO.
